There are a significant number of government acts determining environmental requirements for a franchised motor vehicle dealership.
 
These include; Environmental Protection Act, Pollution Prevention & Control Act, Clean Air Act, Water Act, Noise Act, etc.
 
There are then a significant number of regulations that specify statutory legal requirements enforcing the acts, these form part of the criminal law in the UK.
 
Specifically, within the UK Environmental Protection Act 1990, companies have to exercise a 'duty of care' that particularly applies to wastes they produce.
That legislation is significantly reinforced by The Hazardous Waste (England & Wales) Regulations 2005.
These regulations also impose significant administrative duties, particularly in the keeping of records.
 
There are significant fixed penalty on the spot fines for non-compliance, in addition to very significant penalties for some offences.
 
Key to the legal requirements are the considerations that all wastes are to be considered as 'controlled' and that all hazardous wastes are to be coded per the European Waste Catalogue.
 
Within the new regulations there are an increased number of legal requirements placed upon the company to control all wastes, including hazardous and non-hazardous wastes, up to the point of acceptance by a licensed disposal site.
